  • Who are frontier workers protected by the Withdrawal Agreement?

    The Withdrawal Agreement considers frontier workers protected by the Withdrawal Agreement those who reside in Spain, have Spanish or other EU or European Economic Area nationality and fulfill any of these conditions:

    • Having an employment contract in effect in Gibraltar as of 31 December 2020.
      This section includes workers who are:
      • In a situation of temporary disability due to accident or illness.
      • On maternity leave or on risk leave during pregnancy.
    • Being self-employed with an establishment in Gibraltar as of 31 December 2020, and registered with Gibraltar social security.
    • Having worked in Gibraltar, but, as of 31 December 2020, being in one of the following situations:
      • Being unemployed and enrolled as a job applicant with the Gibraltar Employment Department.
      • Being unemployed while performing a vocational training activity in Spain related to the previous employment. 
  • What rights will frontier workers protected by the Withdrawal Agreement be recognised?

    Frontier workers protected by the Withdrawal Agreement may continue to enjoy the same labour rights and working conditions as they were enjoying before 1 January 2021.

    This includes:

    • Being able to enter and leave Gibraltar freely to develop your work activity with your ID or passport.
    • The right to be treated under the same conditions as British citizens in Gibraltar in terms of salary and other working conditions.
    • Being guaranteed the benefits provided for in Gibraltar in the areas of social security, unemployment, pensions and health care.
    • Being guaranteed the tax benefits provided for in Gibraltar's law.
  • What shall frontier workers do before 31 December 2020 in order to be protected by the Withdrawal Agreement?

    Frontier workers, both employed and self-employed, must ensure that they are duly registered with the Gibraltar Employment Department and the Gibraltar Income Tax Office.

    If you are working, but your employment contract is not properly registered with the Gibraltar Employment Department, you must contact your employer to register the contract with the Gibraltar Employment Department by 31 December 2020.

    If you are a self-employed worker with an establishment in Gibraltar, you must register before 31 December 2020 at Gibraltar's social security system.

    In addition, if you are unemployed and are not yet registered as a job seeker in Gibraltar, you must do so by 31 December 2020 at the Gibraltar Employment Department.

    In addition, to register as a jobseeker, the following documentation will be required:

    1. A duly completed unemployment registration form;
    2. Proof of identity (valid passport or ID card); and
    3. For EU, EEA or Swiss citizens residing in Spain, the Gibraltar Employment Department will also require a "Labour Report" issued by the corresponding Spanish employment office.
  • How can frontier workers verify that the Government of Gibraltar recognises them the status of frontier workers protected by the Withdrawal Agreement?

    The Gibraltar authorities have set up an electronic platform for workers to verify whether they are recognised as frontier workers protected by the Withdrawal Agreement.

    Access to the electronic platform can be done through the website:

    During December, you will be able to check on this website whether the Gibraltar authorities provisionally recognise you the status of frontier worker protected by the Withdrawal Agreement.

    Also, from 1 January 2021, through the consultation of this website, workers will receive definitive confirmation as to whether or not they are considered frontier workers protected by the Withdrawal Agreement.

  • Do I have the right to request that I be certified as a frontier worker protected by the Withdrawal Agreement?

    Yes. The Withdrawal Agreement provides that workers who wish to do so may apply for a certificate certifying them as frontier workers protected by the Withdrawal Agreement.

    This certificate must be applied for from 1 January 2021 at the Gibraltar Employment Department.

  • What shall I do if the Government of Gibraltar does not recognise me as a frontier worker protected by the Withdrawal Agreement?

    If you think that you are eligible to be recognised as a frontier worker protected by the Withdrawal Agreement but, after consulting the electronic platform empowered by the Government of Gibraltar (frontierworkers.gov.gi), you find that you are not recognised such condition, you shall contact the Gibraltar Employment Department asking for the error to be corrected.
