Occupational risk prevention

Occupational risk prevention is the set of measures and activities aimed at protecting the safety, health and well-being of workers in their working environment.

This involves identifying the risks that exist in the workplace, assessing their impact on the health of workers and taking measures to prevent or reduce these risks.

In Spain, occupational risk prevention is regulated by the Law on Occupational Risk Prevention (LPRL), Law 31/1995 of 8 November 1995. This law and its implementing regulations shall be applicable both to the labour relations regulated in the Workers' Statute and to the administrative or statutory relations of the personnel in the service of the Public Administrations, which, in this case, are contemplated in the aforementioned Law or in its implementing regulations.

Employers shall ensure the safety and health of their personnel in all aspects of their work.

As a self-employed worker, you must comply with your occupational risk prevention obligations in the following cases:

  • You are self-employed, have no staff and share a workplace with other people.
  • Or if you are self-employed and have staff to take care of.

The National Institute for Health and Safety in the Workplace is the specialised technical scientific body of the General State Administration whose mission is to analyse and study health and safety conditions at work, as well as to promote and support their improvement. To this end, it will establish the necessary cooperation with the bodies of the Autonomous Communities with authority in this area.

In fulfilling this mission, the Institute shall have the following functions:

a) Technical advice in the drafting of legal regulations and in the development of standardisation, both at national and international level.

b) Promotion and, where appropriate, implementation of training, information, research, study and dissemination activities in the area of occupational risk prevention, with appropriate coordination and collaboration, where appropriate, with the technical bodies in preventive matters of the Autonomous Communities in the exercise of their functions in this area.

c) Technical support and collaboration with the Labour and Social Security Inspectorate in the fulfilment of its surveillance and control function in the field of public administrations.

d) Collaboration with international organisations and development of international cooperation programmes in this field, facilitating the participation of the Autonomous Communities.

Rights of self-employed workers

The owner of the workplace must inform you of the risks of the site, the preventive measures and the protocol for action in the event of an emergency.

Know what risks are produced by the other companies or self-employed workers that may affect your health and safety, as well as what preventive measures have been implemented to avoid them.

Discontinue your activity and leave the workplace when you believe that there is a serious and imminent risk to your life or health.

Obligations of self-employed persons

Report the risks that your activity may cause to other companies or self-employed workers.

Take into account the information provided to you by the other parties at the workplace.

Comply with the instructions of the owner of the facilities and the company that has contracted you.

Report any emergency situation that may affect the health and safety of the people present, as well as any accidents that may occur in the workplace.

If you are going to work on a construction site, you must comply with the Health and Safety Plan.

What is the Coordination of Business Activities?

The coordination of business activities (CAE) is the procedure used to prevent occupational hazards in workplaces where several companies or self-employed workers coincide. It is therefore important that all staff are informed of the risks that an activity may cause, as well as the preventive measures to be taken to avoid them.

The exchange of information between all the parties involved must take place:

  • Before the start of activities.
  • When any change occurs that may generate new risks.
  • When an emergency situation arises.

This information must be in writing in the case of serious or very serious risks. However, it is good practice to have this documentary evidence.

This is a telephone helpline service aimed at resolving queries on occupational risk prevention and IT incidents raised by users of the web portal.

Consultations on preventive management are answered by senior occupational risk prevention technicians.

The STOP Riesgos Laborales line is operational on 913 63 43 00 from Monday to Friday from 9:00 to 14:00 hours.
